Cultivation of Narcotic Plants - Commercial Quantity

Under Section 72B of the Drugs, Poisons and Controlled Substances Act 1981, a person who (without being authorized by or licensed under this Act or the regulations to do so), cultivates or attempts to cultivate a narcotic plant is guilty of an offence.

A person found guilty of this offence, in all other cases besides trafficable quantities, is liable to imprisonment for 1 year, a penalty of 20 penalty units, or both.

A person found guilty of this offence, in cases of trafficable quantities, is liable to imprisonment for 15 years.

Under Section 72A of the Drugs, Poisons and Controlled Substances Act 1981, a person who (without being authorized by or licensed under this Act or the regulations to do so), cultivates or attempts to cultivate a narcotic plant in a quantity of a drug of dependence is guilty of an offence. This only applies if the narcotic plant is in an amount that is not less than the commercial quantity applicable to that narcotic plant.
